U S A Criminal Justice

A man who commits a murder is proven guilty thirty years after another man was sentenced to life.

Now, of course, this would all be simplified if the state had executed the innocent man, so now it is an embarrassment.  Like all those videos showing cops murdering people now. Martin Stroud is the prosecutor who railroaded the innocent man.
Marty Stroud admitted in a letter published in a Louisiana newspaper last month that he was to blame for putting Glenn Ford behind bars in 1983
OK...  so... (Glenn Ford is the victim.)
In the letter, Stroud admitted that he was to blame for mistakenly putting Ford behind bars for the fatal shooting of a jeweler, despite no murder weapon or witnesses placing him at the scene.
'In 1984, I was 33 years old,' he wrote. 'I was arrogant, judgmental, narcissistic and very full of myself. I was not as interested in justice as I was in winning.' 
Mistakenly?  Is that what we call it?  This is an otherwise unheard of event?  OK.. so what to do?
'Glenn Ford should be completely compensated to every extent possible because of the flaws of a system that effectively destroyed his life,' Stroud wrote.
'The audacity of the state's effort to deny Mr. Ford any compensation for the horrors he suffered in the name of Louisiana justice is appalling.' 
Ah, it is the systems' fault, not the individual whose actions are immune from prosecution.  Martin Stroud had nothing to do with this right?   Maybe, just maybe, if prosecutors were answerable for fun-time career-enhancing false prosecutions, there would be fewer executions and incarcerations of innocent poor and minority.  Just maybe.  Martin Stroud did nothing wrong, it is the system!

If Martin Stroud III actually had the slightest concern about what he had done to the man, he would take everything he gained in the last 33 years and give it to the man he personally railroaded up the river, and not condemn the taxpayers for not kicking in to cover up Strouds' malfeasance and personal aggrandizement.

But that ain't gonna happen.  This is America.

We need truth commissions, not government prosecutors.

The government has identified almost 3,000 cases in which FBI agents may have given testimony involving the now-discredited technique. So far only about 500 of those cases have been been reviewed.
Some 268 of those involved FBI examiners providing expert evidence in court that pointed to the guilt of the defendant – of which 257, or 96%, included false testimony.
Most shockingly, at least 35 defendants received the death penalty, 33 of which were the subject of false FBI testimony. Nine of the prisoners were executed and five died from other causes on death row.

Something like 90% of cases involve plea bargain with no trial, so figure about ten times as many people falsely convicted, but no chance of review since they admitted guilt to avoid a life sentence.

The Afflecks Owned Slaves

Ben Affleck, from an old American family, has ancestors who owned slaves.

Oh.

And he asked for and received censroship of this fact.  W T F ?!!??

It is never the facts, it is always the cover-up.
Ben Affleck persuaded the producers of Finding Your Roots to edit out details of how his ancestors were slave owners even though it was a breach of PBS editorial rules.The new Batman star, who supports a number of liberal causes, objected to the ancestry TV show airing how his distant relations were racist, leaked Sony emails reveal.
So what?! If you are long term American, your family probably owned slaves, if you were the right people.  Here is a bill of sale for some slaves my ancestors auctioned off.  On Christmas Eve.



Hell, the Spiers were so tied up in slaves court cases got involved:

Back to that bill of sale...  the Spiers were rich and connected.  A man's sins unto the third and fourth generation...."  We were wiped out four generations after that.

I teach my kids two lessons:

1. Don't worry what crimes your ancestors committed that were "OK" at the time, what crimes are YOU committing now that are "OK" at the time?

2.   Don't fool yourself, all you gain will be lost if it is crime-based.

Affleck said he hopes that, if anything, the PBS controversy would keep the issue of slavery in the national spotlight.
“We deserve neither credit nor blame for our ancestors,” he wrote, “and the degree of interest in this story suggests that we are, as a nation, still grappling with the terrible legacy of slavery.”

Nice diversion, Ben.  The question is not slavery in your case, it is integrity.   The controversy is that you were given the censorship you requested. And now the brand is shot, knowing that the raison d'etre of the show is contrived.

Again, Ben, what crimes do you engage in today that are "OK" today, but will be appalling in the light of cold history?  Think ben, think!

Public Integrity

A retired police detective I know, upon hearing of a police officer fired or prosecuted for some crime, simply says "I wonder who he pissed off."  For it does not happen that wrongdoing has consequences in law enforcement, at any level.  if someone gets the boot, it is because he has displeased some higher up.

So now comes rather strong evidence bitcoin has been a government gig all along, as I have said all along.  How else to explain why a Secret Service Agent and a DEA agent have been arrested for stealing millions form bitcoin while framing the Silk Road participant for drug dealing?

The obvious reason is Bitcoin belongs to the hegemon.
Bridges allegedly diverted to his personal account over $800,000 in digital currency that he gained control of during the Silk Road investigation.  The complaint alleges that Bridges placed the assets into an account at Mt. Gox, the now-defunct digital currency exchange in Japan.  He then allegedly wired funds into one of his personal investment accounts in the United States mere days before he sought a $2.1 million seizure warrant for Mt. Gox’s accounts.     ..
The charges contained in the complaint are merely accusations, and the defendants are presumed innocent unless and until proven guilty...
The case was investigated by the FBI’s San Francisco Division, the IRS-CI’s San Francisco Division, the Department of Justice Office of the Inspector General and the Department of Homeland Security Office of the Inspector General in Washington D.C.  The Treasury Department’s Financial Crimes Enforcement Network also provided assistance with the investigation of this case.  The case is being prosecuted by Assistant U.S. Attorneys Kathryn Haun and William Frentzen of the Northern District of California and Trial Attorney Richard B. Evans of the Criminal Division’s Public Integrity Section.

haahahahahaha...  "Public Integrity Division"  that is hilarious...  excuse me while I wipe away a tear.  If you read on you can see how he used subpoenas to effect his theft.  Subpoenas must be signed by a judge, to "keep the government honest."  Judges have clerks rubber stamp these things.  

Look at all of the people it took to investigate this event.  Has it ever occurred in government to supervise these people?  Would it not take less effort to do that than investigate?  The real purpose for all those names is to impress on the rogues they are not to steal from Bitcoin. Expect slaps on the wrist all around.

Solution:

1. We cannot prosecute the endemic criminality in law enforcement.  The only chance for reform is to set up truth commissions and exile anyone caught lying to the investigators.  Let people keep what the stole, grant immunity for everything, even capital crimes, but get at the truth.  it will set us free.

2. Track all warrants and subpoenas in a central database.  Cops judge-shop, and we should know what the cops know, which judges rubber stamp warrants, etc.  Rate judges on their probity given the outcome of their warrants and subpoenas.

3.  Law enforcement and intelligence seek contradictory ends. Law enforcement is supposed to curb crime, intelligence embraces and extends crime to gather knowledge.  There is no balance of the two,  they are mutually exclusive, and the ends can never justify the means.  One has to go...  Get rid of "intelligence" and deal with crimes as crimes, not opportunities.

American Soldiers and Gulf War Poison Gas

In the first gulf war, when the United States attacked Iraq after Iraq got an "all clear" to invade from US Ambassador April Glaspie for Kuwait stealing Iraqi oil, the USA decided to destroy the poison gas stockpiles we sold to Saddam plus the factories to make more.  Our military did a lousy job of it.
Patrick Eddington, a CIA analyst from 1994 to 1995 who wrote Gassed in the Gulf, resigned when superiors aborted his attempts to reveal the facts. He explained that, “If you’re DOD, you’re admitting your policies contributed to the veterans’ illnesses. If you’re the VA, you’re admitting you don’t know how to treat the vets. If you’re the CIA, you blew another estimate and that’s not something you want on your resume.”
And the Second Gulf War, more of the same.

The reason this goes on and on is we never prosecute military wrongdoing and crimes.  And never will, so let's try something else.  Instead of jail time for crimes, how about just truth commissions, where we have say exile (to Iraq?) for anyone who withholds evidence of wrong doing.

I have no doubt if American citizens were ever to be apprised accurately of the facts, they would do the right thing.  We have rather back-handed proof of that... at the time of the crimes, the powers that be which control the media make sure the facts do not come out.

Why Ferguson?

John Gibson has a late night talk show devoted to the premise that people of African heritage are inferior, and their problems are all their fault.  But maybe not...

Yes, all the time. It is something I see a lot of, whether it was from deputies, supervisors or undercovers and even investigators. It’s almost like you have no emotion with it, that they attach the bodies to it, they’re going to be out of jail tomorrow anyway; nothing is going to happen to them anyway. One of the consequences of the war on drugs is that police officers are pressured to make large numbers of arrests, and it’s easy for some of the less honest cops to plant evidence on innocent people. The drug war inevitably leads to crooked policing — and quotas further incentivize such practices. It doesn’t help that your higherups all did the same thing when they were on the road. It’s like a neverending cycle. Like how molested children accept that as okay behavior and begin molesting children themselves.”

Read the article here where the officers note people of African heritage are particularly selected for false arrest.  Abuse people, then blame them.

I've heard these stories about Seattle for the last 40 years.  From cops.

Well into the 1970s, the USA Centers for Disease control and its predecessor ran curule and harmful experiments on people of African heritage in the USA.  Now it appears they are back at it, this time in Africa itself, with ebola experiments.

Since no one was punished for the crimes in the USA, people feel free to do it again.

Poland & Torture

Civilized countries do not maintain concentration camps or torture camps, so Nazi Germany claimed to be free of those.  Their solution was to have such facilities in other countries.  Of course inside nazi Germany there were plenty of abominable camps, usually transitory or special purpose, but those do not account in a nazi self-assessment. The real nasty places of WWII lore were in countries other than Germany, such as Poland.

The USA today maintains such places around the world and in Guatanamo, to maintain the fiction that no such places exist in USA, an echo of the nazi conceit.  What is odd to day is countries that willingly cooperate with USA crimes.  Whereas poland once claimed the concentration camps, the torture that occurred in their country was while under occupation, what explanation do they have today?
 The European Court of Human Rights on Thursday found “beyond reasonable doubt” that two current prisoners at the Guantánamo Bay detention facility, Abu Zubaydah and Abd al-Rahim al-Nashiri, were transferred from Thailand to Poland by the CIA and tortured there.
Now, the USA should hold truth commissions to come to an understanding how this came to pass.  As to Poland, they may want to do the same, and discover why their lands are so amenable to visitors torturing visitors.

USA and Iraq

My confirmation the USA was lying about the reasons for invading Iraq was when Colin Powell made his presentation to the United nations.  He led the lying about the My Lai massacre, where he was first noticed  as reliable, and then later about "no POWS left behind in Vietnam when in fact some were actually getting out into the 1980s, and so when he was trotted out to make the case, it was rock solid USA was lying.

The title of Powell's autobiography is "It Worked For Me."  No kidding.

Erik Prince Confesses All Crimes at the Acton Institute

I've admired the Acton Institute, and was delighted when Fr. Sirico took apart a torture queen on the topic at one time, and many other initiatives.  I was a little surprised when I learned his institute featured Erik Prince, the mercenary CEO of Blackwater who was paid to do "work" US Soldiers would not.  But, OK, the bigger the sinner the more rejoicing in heaven, when there is repentance.

His book has odd the subtitle "unsung heroes of the war on terror"  You mean no one says "thank you for your service" enough?
Prince, who was raised in the Christian Reformed Church and converted to Roman Catholicism in college, put his faith front and center in his presentation.
What is it about Roman Catholicism that war criminals find so attractive? Newt Gingrich, Tony Blair, Richard Neuhaus, all flocked to RC.  And all of the top death dealers in Bush/Obama are Roman Catholics.  But, never mind, Erik Prince is going to repent and tell all. I like a truth commission.
“My faith has always played a great part in my life,” he said. “If you read the book, you know I’ve made some great mistakes along the way -- terrible mistakes. I’m thankful I have a faith that also includes forgiveness.”
True, true...  but not without repentance, even His Church cannot do that.    So in his confessional, reputation repairing session at the Institute, Erik Prince gets down to business:
Many of Prince’s remarks centered on his insider’s knowledge of the U.S. counter-terrorism effort and the role he played in it. He drew applause when he criticized the Obama Administration’s response to the Sept. 11, 2012 attack on the U.S. embassy in Benghazi in which the U.S. Ambassador to Libya was killed.
Oh.  Blame Obama.  Blame the black guy. "Bless me father, for I have sinned, Obama did it." Never mind no one ever heard of Obama, some shuck and jive community organizer when Erik Prince was doing his crimes, but that is the required doxology if you want right wing warmonger sympathy, "honestly, I blame the black guy."  And it sells books. Blaming the black guy brings down the house!
Prince, who estimated his company became the world’s largest employer of former special operations soldiers at its peak, defended the work his operatives performed in Iraq and Afghanistan on the behalf of the U.S. State Department.
Yes, in all things the USGovt policy is get big or get out. Given that is when and where the crimes occurred, and given that this was supposed to be a reputation restoring mea culpa, how did it come to pass the Acton Institute became the theatre where he affirms he has not repented, but instead blames Obama?
“In the Sioux warrior culture, they regard a warrior not by how far you could run or how hard you could throw a spear, they regarded by who your enemies were,” said Prince...
Don't blame your war crimes on the Sioux.  The Sioux were wiped out in a series of criminal campaigns by USA soldiers.  Erik Prince was doing to the Iraqis in their homes as what USA did to the Sioux in theirs.    Why bring them up when you are billing your talk as a confession?  What do the Sioux have to do with anything?
“If the Hezbollah, the Taliban, the Al-Qaeda and some left wing people like (U.S. Rep.) Henry Waxman are my enemies, I’m OK with that,” he said, drawing applause from the audience of 200. 
Ah So Henry Waxman, who wanted an inquiry into war crimes, is now in the same crew as al-Qaeda and the Taliban.  Anyone who wants an investigation into war crimes is the enemy.  A real crowd-pleaser, that line.  Wait a minute, that puts me in that crowd as well!
“I’m perfectly comfortable with the job we did and with who my detractors are.”
No doubt, since you were paid unspeakable amounts of money to exact criminal activity on innocent people, who could never defend themselves, you never were in any danger from al-Qaeda or the Taliban.  Some confession of wrongdoing. Your activities were the best recruiters for terrorists ever.  War crimes have that effect.

Maybe Erik Prince did not set precisely this girl on fire, but Fallujah was set on fire after four of his mercenaries were killed by Iraqis defending their country.  Plenty of other little girls were set on fire.

The Church says whether the State goes to war is within the prudential judgment of the state, and offers a just cause and just war test for the benefit of warmakers' reflection.  Very neutral.  Next its loyal  institutes glorify war (see George Weigel and now Acton Institute) and creates a Archdiocese for the USA military.  Hardly neutral on this moral issue.  Do you think any of these people have been called in and instructed they ought not receive communion until they repent?

We have prophets who see what is coming, here Francis Cardinal George, Archbishop of Chicago says...
I expect to die in bed, my successor will die in prison and his successor will die a martyr in the public square.
Will the Church faithful be persecuted for not loving war enough?  Or do we love war too much, and having abandoned the teachings of Christ, we get condign punishment?  Is there more the Church can do to facilitate the wars?  The Prophet continues -
His successor will pick up the shards of a ruined society and slowly help rebuild civilization, as the church has done so often in human history.
Just so.  Do we imagine this successors' first act will be to re-establish the military archdiocese?  No, it will be the cheering crowds at Acton who will be lighting the matches under an anti-war Archbishop.

How about we avoid all the bloodshed and go to truth commissions.  Give Erik Prince a chance to really repent, and if not, given what people know, let him deal with comes what may after the truth is outed.

We Can Call It the Khaled Trials

Sheik Khaled is the mastermind behind 9-11.  How do we know?  He said so.  After being waterboarded 183 times in one month.  That's a whole lotta torture to get a confession.  But wait, not only 9-11, he is behind more crimes...

Mohammed confessed to masterminding the September 11 attacks, the Richard Reid shoe bombing attempt to blow up an airliner, the Bali nightclub bombing in Indonesia, the 1993 World Trade Center bombing, the murder of Daniel Pearl, and various foiled attacks, as well as numerous other crimes.

In fact, if you run down the list of crimes, there is about 183 such events, plotting to kill Popes, Presidents, you name it.  I can imagine the waterboarding stopped when the confession was forthcoming.  After confessing to the 2nd or 3rd capital crime, the waterboarding must have been just fun time CIA work.  No doubt all sorts of crimes were submitted to interrogators to be "confessed" by him.

At his trial he quoted the Bible, Thou Shalt Not Kill.  Well, he would say that, wouldn't he?

It is a sad thing when a State gets so big it cannot ever be trusted.  We are at the point people want revolution, they just do not care anymore, they would prefer to escape to anarchy than live in this chaos.

There is a way out:  truth commissions...  no one goes to prison, even for capital crimes, if they tell all.  Subject to what they say to forensics, but exile anyone who refuses to tell any or all and is proven to have done wrong.

It's a reset button.  You have a better way out?  Do you object to the truth getting out?

When Mandela was finally removed from the list in 2008, then senator and current Secretary of State John Kerry, said: "He had no place on our government's terror watch list, and I'm pleased to see this bill finally become law."

Truth Commissions In Action

I do not care for ideas that have no precedence, that have never worked.  Ideas that are in play right now are even better as a source of inspiration.  The idea I have been flogging, truth commissions, in which criminals are offered immunity for complete disclosure, is actually in place right now, and works.

For example, a typical top level federal bureaucrat, who engages in criminal activity, is being thrown under the bus by her bosses.  So she in turn is asking for immunity, if she testifies.
IRS scandal figure Lois Lerner is negotiating through her lawyers with Rep. Darrell Issa’s House Oversight and Government Reform Committee about possibly gaining immunity to testify again in the committee’s investigative hearings.

But the fact is she does, so we need truth commissions.  Let's welcome these instances, and open them wide ...  if you have committed a crime, then you can escape punishment if you come clean.

There is the problem of the community to which you must return after you are acquitted, but then that is your problem.

Shoot 'Em Up!

A few years back I listened to a comedian of some African heritage talking about how whenever he hears a story about a mass shooting he could rest assured the shooter was not black.  I do not recall the whole routine or the name of the comedian, but it was interesting and funny, and true.  My thought at the time si the people behind the experiments which lead to these shootings happen to be profoundly racist as a group, and prefer not to experiment on people of African heritage when it comes to psychological manipulation.  They are happy to experiment with physical manipulation, like the Tuskegee experiments, which introduced to the world unwilling human subjects to experiments, but not psychological.

But now comes a shooter of some African heritage.  So, have they now included people of African heritage in the experiments?

How come there have been no people for African heritage before?  How come the government demands medical records be super secret, even though no one asked for this?

When I hear of one of these regularly scheduled mass shootings, the first thing I listen for is the kill ratio.  In this case 12 dead, 8 wounded...  I think military.  Only a trained shooter can get that high od a ratio.

Why is it so many people who have been trained to kill and then get medical help end up killing a lot of people?

At any time will we ever look at the medicine?  Nooooo... that is super secret...  Since no one ever went to jail of Tuskegee, we will forever have these medical experiments...

Pope Condemns USA Aggression In Syria

While USA Bishops remain silent on the question of the USA unprovoked aggression in Syria, the Pope has no such hesitancy.
Vatican said in a statement after the meeting that the "path of dialogue and of negotiation among all components of Syrian society, with the support of the international community, is the only option to put an end to the conflict and to the violence, which, every day, cause the loss of so many human lives, above all among the defenseless population."
Therefore, there is no just cause for action.  Catholic officers must resign rather than obey orders to attack Syria.  You never hear about it, but it does happen.

I listened to one naval officer explain that one's only chance of getting out of the navy as a conscientious objector is to make your application secretly.  If you make it known to your cohort, then the powers that be must deny your claim for fear others will follow you out.  Hmmmm.....
Days earlier, Francis has said that the use of arms won't resolve the civil war in Syrian where so far has killed over 100,000 people. The United States and its allies are considering a military intervention in response to the Syrian regime's alleged use of chemical weapons in a rebel-held Damascus suburb on Aug. 21, where hundreds died. Syria denies it has used such weapons, and has blamed the rebels for the attack.
Now there is the problem.  Gas was used (not that it is any of the USA's business.....)  But who used the gas, no one knows...

Here again, the truth commissions would work... and maybe the world has a chief judge for the job.  Pope Francis.

A Good Test For Truth Commissions

A good time to test out truth commissions, where anyone who confesses to a crime is exempt from punishment, would be regarding the kennedy assassination.   Few if any believe Oswald acted alone, in fact the official USA position is Oswald did not act alone.  But if not, who else?

Fifty years after, there are still enough people around to get at the truth.   Time to do so.

Indonesian Truth Commissions

In the 1960s there were anti-communist murders widespread, in which over a million people died, usually in a grizzly manner.  Usually there is no statute of limitations for murder, but maybe in Indonesia.  Fifty years later, we have a sort of "Truth Commission" set on film:
Mr. Oppenheimer’s camera observes the rehearsal and shooting of scenes that matter-of-factly evoke unspeakable moments of cruelty and that occasionally arouse powerful emotional responses in participants. At one point, a younger man who has been enlisted to play a torture victim relates the gruesome story of his stepfather’s abduction and murder by, one suspects, his fellow cast members. He tells the tale as if it were a joke, chuckling and assuring the others that he isn’t blaming or criticizing them, and he goes on to give a performance that is almost unbearably credible. Other re-enactments are so intense and realistic that they terrify the participants and cause some of the Pancasila Youth old-timers to marvel at their own sadism.
I doubt I'll watch it, but it does suggest possibilities.
